Belvedere Appartementvermietung GmbH (Belvedere)

1. General The guests of Belvedere Appartements agree with the provided business conditions. The use of an Apartment as well as service of Belvedere is subject to the Austrian Hotel Contract Conditions (ÖHVB) in all points not covered in the contract of the general business conditions. There lays no rent relationship in terms of the Austrian Rent rights statute (Mietrechtsgesetz).


2. Booking regulations The minimum duration of stay with us is 2 nights. Only in certain circumstances will a shorter stay be allowed. Each booking will be confirmed in writing. Any change in a booking must be done at least 14 days before the arrival date. In circumstances, where the apartment is not already assigned to someone else, will we accept extensions for your stay.If the apartment is not in usable condition upon the guest’s arrival or is not the one agreed upon in the contract, a change of apartment or a refund will be issued. Any further liabilities are excluded.The General Terms and Conditions apply to the reservation and the use of the apartment. This, for example applies to the extension of the booking period, the shortening of the stay and the cancellation of the term of the lease.In all cases, in which the apartment should become uninhabitable from reasons, which lie outside of control of the guest, Belvedere will make a spare apartment available to the guest or a full return of any deposit for the apartment will be issued. The final decision is solely up to Belvedere. The maximum liability taken up by Belvedere will be of the deposit, or pre-payments, not recurring ones.Belvedere has the binding right to cancel in writing any confirmed booking 3 months in advance.Guests only included in the reservation details may stay overnight and no one else is permitted on the premises. If you wish to add any more guests, you must discuss this upon your arrival. The change of persons is possible if done later, yet it is necessary to communicate any changes with Belvedere.The apartment may not become a sublet to other persons, and/or subleased. The agreed upon rent does not include any personal insurance, no travel expenses and no transport costs.If an inquiry is submitted to Belvedere, and is answered with an offer, the guest has 24 hours to confirm the booking, otherwise it expires. 


3. Payment If it is not stated otherwise, all prices are in Euros. We accept Cash payment, Bank statement/transfers and credit card (MasterCard, Diners club, Visa, and American Express) payments. If you do not possess a (internationally valid) credit card, or you do not want to share your details, you may pay via bank transfer/banker’s draft or check. In this case, a 25% pre-payment is required at least 4 weeks ahead of arrival; the remaining 75% have to be paid cash on the day of arrival.A pre-authorization is made with a valid credit card, and is not charge. (Not a payment)For reservations lasting up to 31 days of stay, the payment is required to be fully paid upon arrival or beforehand. For stays which exceed 1 month, monthly payments will be required.Upon arrival, the guest is required to submit a form of identification (preferably a Passport) Moreover, the renter is required to fill-out a mandatory registration form. 


4. Cancellations/ Absences / Early Departures Cancelation 14 days prior to arrival is free. Cancellations or changes must be submitted in writing to Belvedere. If the cancellation or change is less than 14 days prior to arrival, a charge for two nights will be deducted from the guest. Cancellation within 96 hours of the arrival date will constitute a charge for the entire booking period. Any pre-payments will be refunded if a written cancellation is made at least 14 days before the arrival or more. Pre-payments will not be refunded if a cancellation is made 96 hours prior to arrival or less or if the guest is a no-show.  The right to stay in the apartment expires at noon the following day that is unless Belvedere has been contacted ahead of time. The most that will be charged in case of change or cancellation is for a duration of two weeks.For special occasions especially Easter, Pentecost, Christmas, New Year and Conferences, special cancellation rules apply, which can be found in the reservation confirmation. 


5. Arrivals/ Departures The Check-in and Check-out will be done through our reception.The opening times are from 9-6 M-F and 2-6 SaSu.If you plan on arriving outside of our opening hours, please let us know by e-mail, fax or telephone.Check-is usually from 14:00 on. At this time the apartment will be ready for check-in. Check-out is usually at 10:00 or before.  The apartment must be cleared by this time. For a late check-out, a 25% day’s fee will be charged for every hour after the Check-out time.If Check-in and –out times differ than what we have, please inform us in writing and we will have to confirm this with you before the date of arrival.If a request for the Belvedere, and you get an offer from us, this expires at the latest after 48 hours, we should have an answer within this timeframe. 


6. Difficulties If it is not possible to move into your booked apartment, because it is in use or you cannot stay there under the available circumstances, then Belvedere is obligated to supply you with another apartment, with the same or higher quality promised. If this is not possible, the money charged will be fully refunded. The total liability is with Belvedere Appartements.The maximum liability of Belvedere Appartements would be what was already paid by the guest. If the guest is confrontational with the reception, staff, guests or damages Belvedere Appartements property, s/he will be asked to vacate the premises immediately. In this case, all payments will not be refunded totalling more than 7 days of booked stay from the date of the incident. The deposit can be used to cover the costs of damages and losses at the fault of the guest. If the damage and/or loss is higher than the deposit, the guest is obliged to pay out-of-pocket for the expenses incurred by Belvedere Appartements and its stakeholders.


7. Capacity The rental price includes the apartment rent, water, electricity as well as a weekly cleaning, change of bed sheets and towels. The amount of towels and bed sheets depend on the number of guests staying in the apartment. Weekly cleaning is provided free of charge, if a guest wishes to have it more often, the cost amounts to 20 euros per cleaning per day. If you wish to ask for a cleaning, please contact the reception. The price includes city tax and any other taxes. The apartments are fully equipped with furniture and inventories. Every room possesses an inventory checklist. During your stay, none of the furniture or inventories may be removed. The guests are obliged to place the items back to their initial position if any of the furniture was moved. If damages to the furniture occur during the guests stay, the guest will have to pay for its replacement. Personal items of the Belvedere are not insured. The inventories lent to the guests as well do not have insurances when damaged during the rental. The guest is responsible for arisen damage, as far as these exceed the normal wear by inhabiting. In particular the guest is responsible for their visitors for damage by carelessness, intentional damage or inappropriate use by him or her. The guest is responsible for damage by inappropriate use, by fire, by special damage or soiling of textiles, with broken table-ware. Cost of repair, replacement or special cleaning are to charged from the guests. The tenant is responsible for the keys handed over. If a key should be lost, both the key and the cylinder must be replaced. The costs of it are to be paid by the guest. There is not a possibility that Belvedere takes the responsibility for it. If necessary the guest will also be responsible for any work done by a locksmith. 8. If necessarily thereby coherent locksmith's works are also to be carried.


8. General 
Regulations for Entering Apartments
Employees of Belvedere are permitted to enter the apartments at any time. The employee has to act without disturbing the renter. Entering the apartment will usually occur: for investigation, cleaning, repairing damages. 

Liability
Belvedere is not liable for problems/cases outside of properties belonging to Belvedere Appartements. These include problems with electricity, water, internet, break-ins, illness, etc… Belvedere Apartments LTD and its partners are not liable for loss of property of the guests.

Suggestions /Complaints
We kindly ask that all suggestions and complaints be submitted in written form. We give our best to meet the highest service standards of our guests. The better the detail are described, the quicker and more efficiently the problems will be solved. Complaints, submitted at the end of your stay will not be fully addressed by us and Belvedere Appartments will not be liable. 

Insurance
Belvedere does not insure their guests. We strongly recommend insuring yourself privately including luggage insurance, trip illness, and cancellation of the trip from beginning to end.

Trash
The guests are asked to dispose their trash in garbage bins in the courtyard. 

Smoking
It is forbidden to smoke in the apartments. 

Internet
Daily internet usage allows for 100MB (Megabytes) for each apartment. If the data usage is exceeded, a charge of 10€ per 100 MB will be charged to the guest.   

Garage/ Park Cards
A key will be provided for the garage. A park card is also available for street parking. In case the park card or the key are not returned to Belvedere Appartements at the end of the rental agreement a fee of 100€ will be charged to the guest. A deposit (50,- €) in this amount will be provided to reception by the guest upon acceptance of the key or park card.

Special Arrangements 

Special arrangements will always be done in written form. The guest has the right to request more or less of what has been provided to him/her in the rental package.The guest is required to pay for all fees associated with the rental of an apartment. This does not include (and therefore must be paid for separately) deposits, garage space, park cards, internet, etc. The renter authorizes Belvedere Appartements to charge his/her credit card any fees associated with the stay, which incurred after the initial payment by the guest. This includes, lost key, exceeding data of 100MB per day, lost park cards, damages,  etc.
